This website is operated by Trophy Mall. Throughout the site, the terms “we”, “us” and “our” refer to Trophy Mall. Trophy Mall is an Indian retailer of trophies, medals, awards, plaques, shields and corporate gifts, and offers this website, including all information, tools and Services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including the additional terms, conditions and policies referenced here or available by hyperlink. These Terms apply to every user of the site, including browsers, customers and contributors of content.

Please read these Terms carefully before using our website. By accessing or using any part of the site, you agree to be bound by them. If you do not agree to all of them, you may not access the website or use any Services.

Any new features or tools added to the store are also subject to these Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of them by posting updates to this website, and it is your responsibility to check this page periodically. Your continued use of the site after a change is posted constitutes acceptance of that change.

1. ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least the age of majority in your state of residence, or that you have given us consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose, nor may you, in using the Service, violate any law in your jurisdiction (including but not limited to copyright law). You must not transmit any worms or viruses or any code of a destructive nature. A breach of any of these Terms will result in immediate termination of your Services.

2. ORDERS AND ACCEPTANCE

Your order is an OFFER to buy. It is not accepted, and no contract is formed, until we confirm that the order has been DISPATCHED. An order confirmation or payment receipt acknowledges that we have received your order; it is not acceptance of it. We may decline or cancel any order, in whole or in part, where an item is out of stock, where there has been a pricing or listing error, where delivery to your address is not possible, or where we suspect fraud. If we do, you receive a full refund of everything you have paid for that order, including any delivery charge. We may limit or cancel the quantity purchased per person, per household or per order. These restrictions may include orders placed under the same customer account, the same card, or the same billing or delivery address. You agree to provide current, complete and accurate purchase and account information for every purchase, and to keep it up to date so we can complete your transactions and contact you when needed.

3. ENGRAVING, PERSONALISATION AND ARTWORK APPROVAL

Most of our products can be engraved or personalised. Before anything is produced, we send you a PROOF of the engraving for your approval. YOU ARE RESPONSIBLE FOR THE ACCURACY OF THE ARTWORK YOU APPROVE - including the spelling of names, titles, dates, scores and any other text or logo. We produce exactly what is approved. An error in text you have approved is not a defect and does not entitle you to a refund, replacement or return. Please read the proof carefully and take the time you need. Production does not start until you approve it, and the dispatch timelines quoted on our Shipping & Delivery page run from the date of your approval, not from the date of your order. If the item you receive does NOT match the proof you approved, that is our error. Report it within 48 hours of delivery with photographs and we will remake it or refund you in full, as set out in our Refund Policy: Refund Policy By sending us a logo, emblem, crest, photograph or any other artwork, you confirm that you own it or are authorised to use it, and that engraving it does not infringe anyone else's rights. We may decline to reproduce artwork where that is in doubt. Engraved, personalised, custom-text and made-to-order items are NON-RETURNABLE, because they cannot be resold. This does not affect your rights where the item arrives damaged or defective, or where the engraving differs from the approved artwork. Slight variations in finish, shade, grain and the exact positioning of engraving are inherent to how these pieces are made and are not defects.

4. BULK AND CORPORATE ORDERS

We supply schools, colleges, clubs, sports associations and companies in quantity. Bulk and corporate pricing is QUOTED ON REQUEST rather than listed on the site. A quote is valid for 15 days from the date we issue it, unless it states otherwise. Bulk orders may require an advance payment before production begins. Production and delivery timelines for a bulk order are those confirmed in writing with the quote, and they replace the standard timelines published on our Shipping & Delivery page. Where pieces have already been engraved with your organisation's details, those pieces cannot be cancelled or returned.

5. PRODUCTS, PRICES AND AVAILABILITY

All prices are in Indian Rupees (INR). Taxes apply as applicable and are shown at checkout. Prices are subject to change without notice. We reserve the right to modify or discontinue any product or the Service, or any part of either, at any time without notice, and we are not liable to you or to any third party for any such change, suspension or discontinuance. We have made every effort to display the colours, materials and finishes of our products as accurately as possible. We cannot guarantee that your screen's display of any colour or finish will be accurate, and a reasonable difference between the photograph and the physical piece is not a defect. Products may be available in limited quantities and are returnable or exchangeable only in accordance with our Refund Policy: Refund Policy We reserve the right, but are not obliged, to limit sales of our products to any person, geographic region or jurisdiction, on a case-by-case basis.

6. PAYMENT

Online payments are processed by Razorpay, which accepts cards, UPI and net banking. Trophy Mall does not see or store your card, UPI or bank credentials at any point; they are handled entirely by the payment provider. Cash on Delivery is available on eligible orders and pincodes, and may not be offered on personalised, bulk or high-value orders. If a payment fails, is reversed or is charged back after dispatch, we may withhold or cancel the order and recover the goods or the amount due.

7. SHIPPING, DELIVERY AND RETURNS

Dispatch times, delivery estimates, serviceability and damage reporting are set out on our Shipping & Delivery page and form part of these Terms. Delivery estimates are estimates, not guarantees, and time is not of the essence unless we have confirmed a specific event date with you in writing. Cancellations, returns and refunds are governed by our Refund Policy: Refund Policy Risk in the goods passes to you on delivery. Please check your order on arrival and report any damage within 48 hours with photographs of the item and of its packaging.

8. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for a decision. Any reliance on it is at your own risk. This site may contain historical information, which is provided for reference only and is not necessarily current. We may modify the contents of this site at any time but have no obligation to update any information on it.

9. ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability. We reserve the right to correct any such error and to change or update information, or cancel an order, if any information is inaccurate at any time without prior notice, including after you have submitted your order. Where an order is cancelled for this reason you receive a full refund.

10. THIRD-PARTY LINKS AND TOOLS

Certain content, products and Services available through our Service may include materials from third parties, and third-party links on this site may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we accept no liability for any third-party materials or websites. Any third-party tools we make available are provided “as is” and “as available” without warranties of any kind. Use of them is entirely at your own risk, and you should familiarise yourself with the terms on which the relevant provider offers them.

11. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you send us creative ideas, suggestions, proposals, reviews or other materials, whether at our request or otherwise (collectively, “comments”), you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium without restriction. We are under no obligation to keep any comments in confidence, to pay compensation for them, or to respond to them. We may, but need not, monitor, edit or remove content we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes any party's intellectual property or these Terms. You agree that your comments will not violate any right of any third party and will not contain unlawful, abusive or obscene material or malware, and that you will not use a false email address or impersonate anyone. You are solely responsible for the comments you make and their accuracy. This clause does NOT apply to engraving artwork you send us for an order: that is governed by Section 3 and by our Privacy Policy, and is used only to produce your order.

13. PROHIBITED USES

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful act; (c) to violate any regulation, rule, law or local ordinance; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website. We may terminate your use of the Service for violating any of these.

14. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that the results obtained from it will be accurate or reliable. You expressly agree that your use of, or inability to use, the Service is at your sole risk. Except as expressly stated by us, the Service and all products delivered through it are provided “as is” and “as available”, without representation, warranty or condition of any kind. Nothing in these Terms excludes or limits any right you have under the Consumer Protection Act, 2019 or any other law of India that cannot lawfully be excluded. Subject to that, in no case shall Trophy Mall, or its directors, officers, employees, affiliates, agents, contractors, suppliers or service providers, be liable for any injury, loss, claim, or any indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue or loss of data, arising from your use of the Service or of any product obtained through it. Where liability cannot be excluded, it is limited to the amount you paid for the order concerned.

15. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Trophy Mall and its affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or of any law, or out of artwork you supplied for engraving.

16. SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed. Such a determination does not affect the validity and enforceability of any remaining provision.

17. TERMINATION

The obligations and liabilities of the parties incurred before the termination date survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services.

18. ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with any policies posted by us on this site, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements, communications and proposals, whether oral or written, including any prior version of these Terms. Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

19. GOVERNING LAW AND JURISDICTION

These Terms, and any separate agreement under which we provide you Services, are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts at Puducherry.
